Why Chandigarh Is the Working Base for These Matters
Chandigarh is the seat of the Punjab & Haryana High Court, which has jurisdiction over the States of Punjab and Haryana and the Union Territory of Chandigarh. For the large NRI population with family roots in this region, criminal proceedings, property disputes, matrimonial cases and revenue matters overwhelmingly fall within this court’s jurisdiction rather than the High Courts at Delhi or Bombay.
Work that begins as a village land dispute in Punjab, an FIR registered at a district police station, or a mutation entry in the revenue record is ultimately heard, appealed or supervised here.
Courts and Authorities Matters Are Conducted Before
| Forum | Typical NRI matters |
| Punjab & Haryana High Court, Chandigarh | Quashing under Section 528 BNSS, anticipatory bail under Section 482 BNSS, writs under Article 226 including Look Out Circular challenges, second appeals in property matters |
| District Courts, Chandigarh | Civil suits for possession, partition and declaration; matrimonial petitions; sessions matters |
| District Courts, Panchkula and Ludhiana | Suits and criminal proceedings arising in those districts |
| Revenue authorities | Jamabandi (record of rights), intkal (mutation) and fard extracts; correction and demarcation proceedings |
| Supreme Court of India | Appeals and special leave petitions where High Court relief is refused |
Practice Areas Covered
The areas of practice are set out below, each linking to the detailed guide for that subject.
- Criminal — FIR quashing, anticipatory bail, Look Out Circulars, proclaimed offender proceedings, and complaints under Section 85 BNS (formerly 498A IPC)
- Property — property disputes, illegal occupation (kabza), partition, title verification and builder possession claims
- Family — divorce and matrimonial proceedings, custody and maintenance
- Documents and status — Powers of Attorney, passport matters, OCI matters and wills and inheritance
- Police assistance — filing a police complaint from abroad
How a Matter Runs for a Client Living Abroad
- Papers first. The Indian record is obtained — the FIR, order sheet, revenue extract or passport decision — before advice is given on strategy or travel.
- Authority to act. Where the client cannot attend, a Power of Attorney is drafted for execution abroad and, where required, stamped and registered in India. The UK execution chain is set out separately.
- Filing and hearings. Petitions are filed and argued by counsel. Personal appearance is required only where the court directs it, or where the step is one only the party can take.
- Orders and compliance. Certified copies are obtained and any consequential step is carried out — communicating a quashing order to the police station, or a revocation to the Sub-Registrar.
Appointments accommodate the client’s time zone. Nothing here should be read as a statement about the outcome or duration of any proceeding, both of which are for the court.

Frequently Asked Questions
Which High Court hears NRI matters from Punjab and Haryana?
The Punjab & Haryana High Court at Chandigarh has jurisdiction over Punjab, Haryana and the Union Territory of Chandigarh. Quashing petitions, anticipatory bail applications and writ petitions arising in those areas are filed there.
Do I need to travel to Chandigarh for my case?
Not for most steps. Where the client cannot attend, work proceeds on a Power of Attorney and counsel appears. Some steps remain personal, including certain appearances and bond conditions in criminal matters, and the court decides whether attendance is excused.
Can a property matter in a Punjab village be handled from Chandigarh?
Yes. The revenue record for the village, including the jamabandi and any mutation entry, is obtained, and the suit or revenue proceeding is filed before the court or authority with jurisdiction over that land.
What is the difference between the Chandigarh District Court and the High Court here?
The District Court is the trial forum for suits and sessions matters arising in Chandigarh. The High Court exercises appellate, revisional and writ jurisdiction, and hears quashing and anticipatory bail matters for the region.
How is a first consultation arranged from abroad?
By telephone, WhatsApp or video, at a time that fits the client's time zone. It helps to have the FIR number, case number or property description available beforehand.
Are matters outside Punjab, Haryana and Chandigarh handled?
Where an FIR or suit lies in another State, jurisdiction is advised at the first consultation and the matter is conducted before the appropriate court, with associated counsel in that State where required.
